1. Our Services

We provide property consulting, analysis, research, and advisory services in relation to the UK real estate market.

Our work may include: deal sourcing, market analysis, investment appraisals, project oversight, and introductions to third parties.

We do not provide regulated financial advice or investment management services.

2. Regulatory Status

Festa & Co is not authorised or regulated by the Financial Conduct Authority (FCA).

Any information we provide is for general information and educational purposes only.

You should seek independent financial, legal, or tax advice before making any investment decisions.

3. Client Responsibilities

You are responsible for making your own independent decisions regarding property acquisitions, disposals, or investments.

You must ensure that any funding, financing, or contractual arrangements you enter into are appropriate for your circumstances.

If we introduce you to a third party (e.g., estate agent, broker, solicitor, or vendor), you are responsible for conducting your own due diligence on that party.

4. Fees and Payment

Where fees are agreed for services, these will be confirmed in writing before any engagement.

Fees must be paid in accordance with the agreed schedule and are non-refundable unless otherwise stated in writing.

In some cases, we may work on a success-based or joint-venture arrangement. These will always be subject to a separate written agreement.

5. Confidentiality

We treat all client information as confidential and will not share it without your consent, except where required by law or for compliance purposes.

Likewise, you agree not to share confidential information provided by us without our consent.

6. Limitation of Liability

While we strive to provide accurate and reliable information, we do not guarantee that any analysis, forecasts, or insights will prove correct.

Festa & Co accepts no liability for any loss, damage, or costs incurred as a result of reliance on our services or materials.

Our total liability in relation to any engagement shall not exceed the total fees paid by you for our services in that engagement.

7. Anti-Money Laundering and Compliance

As a business involved in property introductions, we are subject to Anti-Money Laundering (AML) regulations.

We may request identification documents from you and must decline to act if these are not provided.

8. Termination

Either party may terminate an engagement by giving written notice.

You remain liable for all fees incurred up to the date of termination.

9. Governing Law

These Terms of Business are governed by the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the English courts.
